Preparing to keep Aryan Khan in jail for months like Riya Chakraborty? NCB has adopted a similar approach

Shahrukh Khan’s son Aryan Khan is arrested in the Cruise Drugs Case and is serving 14 days of judicial custody in Arthur Road Jail. The arguments in the sessions court on the bail of Aryan, who became prisoner number 956 in the jail, have been completed and now on October 20, Judge VV Patil will give his verdict on this. While Aryan’s lawyers are hopeful that Aryan will be released, the preparations of the Narcotics Control Bureau (NCB) seem to be different. After the death of Sushant Singh Rajput, the action of NCB on the nexus of drugs that came to the fore in Bollywood has increased in a very aggressive manner, while the arrest of Rhea Chakraborty and Aryan’s arrest. There are similarities on the part of NCB, seeing that it seems that the Bureau of Investigation is also preparing to keep Aryan in jail for months!

In the investigation of Sushant Singh Rajput’s death, the NCB took action on the drug chat. As a result, Sushant’s girlfriend Riya Chakraborty and his brother Souvik Chakraborty were arrested. Riya Chakraborty was not granted bail by the court and she had to spend almost a month as a prisoner in Byculla jail. It is interesting that in both the cases, whether Aryan or Riya, NCB did not find any drugs from both of them. Neither did the blood test reveal that both had taken drugs. However, according to the NCB’s Panchnama, Aryan has admitted that he had consumed charas at the cruise terminal on the night of October 2.

Now if we look at the methods of investigation of both the cases, the evidence presented by the NCB in the court and the arguments of the arguments before the judge, then both Aryan and Riya Chakraborty have a lot in common. Then their phones were confiscated and then both were arrested on the basis of WhatsApp chats.

CBI, ED and NCB, the three largest agencies of the country are investigating this case, although even after a lapse of more than a year, no agency has reached any conclusion in the case yet.

In the Aryan Khan case, the NCB has claimed in the court that they have received such chats from Aryan’s phone, which proves that Aryan was in touch with the peddlers. Not only this, according to the NCB, there are talks with foreign drug suppliers in these chats and there is talk of buying drugs in large quantities i.e. commercial quantity. This is the reason why NCB suspects that Aryan’s strings are linked to international drug smugglers. On the other hand, the situation was similar in the case of Riya Chakraborty.

The NCB cited such WhatsApp chats in Riya Chakraborty’s phone to prove that Riya was directly involved in the purchase and acquisition of drugs. The same is true in the FIR registered against Riya. The agency later also claimed that they had evidence that Riya paid money to buy drugs. The NCB also invoked Section 27A of the NDPS against Riya Chakraborty, which deals with the purchase of drugs and harboring criminals who commit such illegal acts. It was also said that Rhea Chakraborty is an active member of the drug syndicate and she used to order drugs for Sushant.

Appearing for the NCB in the court, ASG Anil Singh also argued that during the raid on the cruise, 6 grams of charas was recovered from Arbaaz Merchant, Arbaaz Merchant. Both were together and it was for both the drugs to be consumed. In such a situation, it would be wrong to say that drugs were not found from Aryan.

Arbaaz’s lawyer Tarak Saeed argued in the court that nothing has been proved in the chat, as sending a message and committing a crime are two different things. Advocate Amit Desai, appearing for Aryan, also told the court that there is no discussion about the rave party on cruise in any of the chats. One thing to note here is that it has been argued in court in old cases regarding drugs that WhatsApp chats do not prove anything due to lack of evidence.

‘Talked in chat, not necessarily crime’
Apart from the case of Aryan and Riya, earlier this year the Anti-Narcotic Cell of Mumbai Police arrested actor Dhruv Tahil. It was claimed that there is evidence of a chat with a drug paddler on the actor’s phone. Evidence of the transaction between the two is also in the phone. However, in June, Tahil was granted bail by the court observing that no conspiracy or drug smuggling has been proved here. Tahil’s lawyer Shekhar Jagtap had said in the court, ‘A person can do such things even to boast on chat. But that does not mean that he has committed that crime. If there has been a crime, there should be solid proof of it.

The target of agencies like NCB are mainly drug peddlers. Wherever there have been arrests before in the parties, blood test is done to find out whether the accused has consumed drugs or not. It has already been said in many courtrooms on the allegations of consumption in drugs case that in such cases the abuser should be considered as the victim. According to the NDPS Act, if a person wants to get rid of intoxication on the charge of consumption, then he cannot be punished. In 2001, in the case of Bollywood actor Fardeen Khan, he was arrested by the NCB for using cocaine. He chose drug addiction. In 2001 itself, the sentence of drug abuser was reduced from five years to one year.

Whether Aryan Khan gets bail on October 20, only time will tell. But in Riya Chakraborty’s case, another argument was given, which echoed in Aryan’s case also in the courtroom. NCB argued that celebrities are role models and they have a great responsibility towards the society. But we also have to remember that last year itself, the Bombay High Court had rejected this argument while granting bail to Riya Chakraborty. The court said, ‘I do not agree with this. Everyone is equal before the law.’

Aryan Khan’s lawyer Amit Desai had cited the same point of view of the Bombay High Court in the last hearing. Former Attorney General Mukul Rohatgi has also reacted to the Aryan case, saying that he is facing the brunt of being the son of a superstar. The decision of bail or imprisonment is in the hands of the court. It is too early to say what happens next in the NCB investigation and which way the agency will go ahead. But the way in the Riya Chakraborty and Aryan Khan case, only ‘drugs chat’ is being presented on the basis, it is clear that the preparation of NCB is to keep Aryan in Arthur Road jail for a few more days.
